Welcome to the Videogames and Esports Foundation! Now that you’re here, we would like to explain some rules for using our website, www.vef.gg (the “Website”), and any services provided in connection with the Website (collectively with the Website, the “Services”).
These rules, otherwise known as your rights and responsibilities, are officially set forth in this Terms of Use Agreement (“Terms of Use” or “Agreement”). The binding legal contract is made between you and Videogames and Esports Foundation, Inc. (“VEF”), which we may also refer to as “our,” “we” and “us.” This Agreement applies to all visitors, users, and others who access or use our Services (“Users”).
PLEASE READ THIS AGREEMENT CAREFULLY BEFORE YOU USE OUR WEBSITE AND/OR DONATE. BY DONATING TO OUR FOUNDATION OR OTHERWISE USING OUR WEBSITE AND/OR SERVICES, YOU INDICATE THAT YOU HAVE READ AND UNDERSTAND THESE TERMS OF USE, AND THAT YOU AGREE TO ABIDE BY THEM. IF YOU DO NOT AGREE TO THESE TERMS OF USE, YOU MAY NOT USE OUR WEBSITE AND/OR SERVICES.
VEF PRIVACY POLICY
VEF strives to create an inclusive, safe, and aspirational network of gaming communities for all.
By donating to the VEF, you affirm that you have read and understand this Privacy Policy and expressly consent to our collection, storage, and disclosure of your personal information in accordance with its provisions, as well as our Terms of Use. All capitalized terms used in this Privacy Policy that are not defined herein shall have the meaning given to them in our Terms of Use or other applicable agreements.
We encourage you to familiarize yourself with our privacy practices and contact us with any questions or concerns. If you do not want us to collect and use your personal information as described in this Privacy Policy, we encourage you not to use our Services.
DONATIONS
By donating, you agree to the terms set forth on our Website (which may be updated from time to time) or otherwise set forth in an agreement with VEF. Donors will be required to provide a credit card, debit card, or another similar payment method (“Payment Method”) in order donated through any platform we promote on our site.
VEF will automatically charge your Payment Method for fees when due, and you hereby authorize VEF to bill such fees and applicable taxes to your Payment Method. If there is no Payment Method associated with your VEF donation, we will send you an invoice for the fees due, which you must pay within thirty (30) days of your receipt. You acknowledge that the amount billed may vary due to promotional offers and changes in applicable taxes, and you authorize us to charge your Payment Method or invoice you for the corresponding amounts.
INDEMNIFICATION
You agree to defend, indemnify, and hold harmless VEF, along with its subsidiaries, agents, licensors, managers, and other affiliated companies, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (1) your use of and access to our Services, including any data or content transmitted or received by you; (2) your violation of any term of this Agreement, including without limitation your breach of any of the representations and warranties above; (3) your violation of any third-party right, including without limitation any right of privacy or Intellectual Property Rights; (4) your violation of any applicable law, rule or regulation; (5) User Content or any content that is submitted via your VEF donation including without limitation misleading, false, or inaccurate information; (6) your willful misconduct; or (7) any other party’s access and use of the Service with your unique username, password, or other appropriate security code.
LEGAL CLARIFICATION
The Terms of Use, including any incorporated policies and other agreements, supersede any other agreement between you and VEF regarding the Services. If any part of the Agreement is found to be unenforceable, that part will be limited to the minimum extent necessary so that the Terms of Use will otherwise remain in full force and effect. Our failure to enforce any part of the Agreement is not a waiver of our right to later enforce that or any other part of the Terms of Use. We may assign any of our rights and obligations under the Terms of Use.
CHANGES TO OUR TERMS OF USE
We may update our Terms of Use in our sole discretion at any time. When we make changes, we will update the “last modified” date at the bottom of this page. Minor changes will be effective immediately upon posting on our Website.
When we change the Terms of Use in a material manner, we will notify you that material changes have been made to the Agreement by posting them here or sending you an email. VEF reserves the right to determine the form and means of providing notifications to our Users and is not responsible for any automatic filtering you or your network provider may apply to email notifications we send to the email address you provide us.
Your continued use of the Service after any such change constitutes your acceptance of the new terms. If you do not agree with the new terms, you must discontinue your use of our Services.
